1. Eligibility

2. Services Provided
Elevated Automation provides AI-powered lead capture, communication, and automation systems designed to help businesses manage inbound inquiries, follow-up processes, and customer interactions.
Service features may evolve over time to improve performance or adapt to platform changes.
We do not guarantee specific results, including but not limited to revenue, lead volume, or conversion rates.
3. Service Plans & Billing
Services are provided on a subscription basis based on the selected plan:
- Essential
- Growth
- Automation Pro
Billing is charged on a recurring monthly basis unless otherwise stated.
By completing a purchase, you authorize Elevated Automation to charge your payment method for all applicable subscription fees and services.
4. Trial Period
If a trial period is offered, billing will automatically begin at the end of the trial unless canceled prior to the trial expiration.
5. Cancellation
You may cancel your subscription at any time:
- Cancellation will stop future billing
- No refunds are provided for any charges already billed
- Services may remain active until the end of the current billing period
6. Setup Fees (If Applicable)
Certain plans may include a one-time setup fee.
Setup fees are non-refundable once onboarding or system configuration has begun.
7. Payments & Refunds
- Subscription fees are billed in advance
- All payments are non-refundable once billed
- Failure to maintain valid payment may result in suspension of services
8. Client Responsibilities
You agree to:
- Provide accurate business information
- Maintain required integrations and third-party accounts
- Ensure proper consent for any contacts used in messaging systems
- Remain responsible for sales, fulfillment, and customer interactions
9. AI Communication & Messaging Compliance
- You acknowledge that communications may be automated or AI-assisted, including SMS, email, voice, and messaging platforms.
- You are responsible for complying with all applicable laws, including but not limited to TCPA and CAN-SPAM.
- Opt-out mechanisms (such as replying STOP) will be honored where supported.
10. SMS Communications & Consent
By submitting your information and providing consent, you agree to receive communications related to your account and services.
Message frequency may vary. Message and data rates may apply.
You may opt out at any time by replying STOP.
We do not sell or share your phone number or consent data.
11. Third-Party Services
Our Services may rely on third-party platforms. We are not responsible for outages, limitations, or changes to these platforms.
12. Intellectual Property
All systems, automations, workflows, and materials remain the property of Elevated Automation unless otherwise agreed in writing.
13. Disclaimer of Warranties
Services are provided “as is” without warranties of any kind.
14. Limitation of Liability
Liability is limited to one (1) month of fees paid.
We are not liable for indirect or consequential damages.
15. Suspension & Termination
Elevated Automation may suspend or terminate services immediately if:
- payment is delinquent or fails
- these Terms are violated
- system usage poses a risk to operations
- the Client engages in abusive, unethical, or illegal conduct
Elevated Automation may also terminate services for any reason with reasonable notice.
16. Changes to Terms
We may update these Terms at any time. Continued use constitutes acceptance.
17. Acceptance of Terms
By purchasing, subscribing, or using the Services, you acknowledge that you have read, understood, and agree to these Terms.
