Terms of Service

By accessing or using the website, services, systems, subscriptions, or products provided by Elevated Automation (“Company,” “we,” “us,” or “our”), or by completing a purchase, signing an agreement, or subscribing to any service, you agree to be bound by these Terms of Service (“Terms”).
If you do not agree to these Terms, do not use our website or services.
1. Eligibility
You must be at least 18 years old or the legal age of majority in your jurisdiction to use our services.
2. Services Provided
Elevated Automation provides marketing, website, CRM, lead capture, tracking, automation, and digital growth services for businesses. Services may include, but are not limited to:
- Google Ads management
- Website design, website refreshes, and landing pages
- Lead capture systems and CRM setup
- Local SEO and Google Business Profile optimization
- Review generation and reputation systems
- Call tracking and lead source reporting
- AI chat, AI voice, missed-call follow-up, and automated lead response systems
- Email, SMS, and workflow automation
- Reporting, consulting, and related marketing support
Service features, platforms, deliverables, and processes may change over time to improve performance, adapt to third-party platform changes, or support operational needs.
We do not guarantee specific results, including but not limited to revenue, rankings, lead volume, cost per lead, call volume, conversion rates, ad performance, appointment volume, or closed sales.
3. Service Plans, Subscriptions, and Billing
Services may be provided through one-time setup fees, recurring subscriptions, project-based fees, or custom agreements.
Available services may include:
- Website + Lead Capture System
- Google Ads Management
- Local SEO + Review Growth
- AI Lead Response Kit
- Custom marketing, CRM, automation, or consulting services
Billing terms, pricing, service scope, and renewal terms are based on the selected service, signed agreement, invoice, order form, or subscription.
By completing a purchase, signing an agreement, or subscribing to a service, you authorize Elevated Automation and/or its payment processor to charge your payment method for all applicable fees.
4. Ad Spend and Third-Party Costs
Unless otherwise agreed in writing, advertising spend is paid directly by the Client to the advertising platform, such as Google, Meta, or other ad networks.
Third-party software, tracking tools, domains, hosting, plugins, CRM tools, call tracking platforms, email/SMS costs, AI tools, or other outside services may be billed separately or included depending on the selected plan or agreement.
Elevated Automation is not responsible for third-party billing issues, platform outages, price increases, suspensions, or policy changes.
5. Trial Periods
If a trial period is offered, billing may automatically begin at the end of the trial unless canceled before the trial expires.
Trial features, duration, and included services may vary by offer.
6. Cancellation
You may cancel your subscription according to the cancellation terms in your agreement or by contacting Elevated Automation.
Unless otherwise stated in writing:
- Cancellation stops future billing.
- No refunds are provided for charges already billed.
- Services may remain active until the end of the current billing period.
- Setup fees, onboarding fees, and completed work are non-refundable.
7. Setup Fees and Project Fees
Certain services may include one-time setup fees, onboarding fees, website build fees, landing page fees, campaign setup fees, or project-based fees.
Setup and project fees are non-refundable once onboarding, strategy, design, configuration, campaign buildout, tracking setup, website work, or other service work has begun.
8. Payments and Refunds
Subscription fees are billed in advance unless otherwise stated.
All payments are non-refundable once billed, including but not limited to setup fees, monthly retainers, project fees, subscription fees, and completed service work.
Failure to maintain a valid payment method or pay outstanding invoices may result in suspension or termination of services.
8A. Chargebacks and Billing Disputes
Client agrees to contact Elevated Automation and make a good-faith effort to resolve any billing concern before initiating a chargeback, payment dispute, or reversal with a financial institution or payment processor. If a chargeback or payment dispute is initiated for services provided in accordance with these Terms, Elevated Automation reserves the right to suspend services, terminate services, and pursue recovery of unpaid balances and reasonable costs incurred in responding to the dispute.
9. Client Responsibilities
You agree to:
- Provide accurate business information.
- Provide timely access to required accounts, websites, domains, CRMs, ad accounts, tracking tools, and third-party platforms.
- Maintain required third-party accounts, integrations, billing, and platform access.
- Review and approve marketing materials, website content, landing pages, ads, tracking, and messaging when requested.
- Ensure your business has proper authority, licenses, certifications, and legal ability to advertise and provide its services.
- Ensure proper consent for any contacts used in SMS, email, phone, review, or automated messaging systems.
- Remain responsible for sales, pricing, fulfillment, customer service, appointment handling, and customer interactions.
- Comply with all applicable laws, regulations, advertising policies, privacy rules, and communication requirements.
Delays caused by missing information, delayed approvals, unavailable access, or third-party platform issues may affect timelines and performance.
Client agrees to respond to reasonable requests for information, approvals, account access, feedback, or required materials within three (3) business days whenever possible. Delays caused by missing information, unavailable access, delayed approvals, or lack of communication may affect timelines, campaign performance, service delivery, and project completion dates.
9A. Client Cooperation
Elevated Automation's ability to deliver services depends on timely cooperation from the Client. If the Client fails to provide required information, approvals, access, feedback, or communication for a period exceeding ten (10) consecutive calendar days, Elevated Automation may pause, suspend, or terminate services without refund. Elevated Automation reserves the right to terminate services if ongoing lack of cooperation prevents effective service delivery.
10. Advertising and Marketing Performance
Elevated Automation may manage or support advertising campaigns, landing pages, SEO efforts, website updates, review systems, CRM workflows, and tracking systems.
You acknowledge that marketing results are affected by many factors outside of our control, including but not limited to:
- Market demand
- Competition
- Seasonality
- Budget
- Offer quality
- Pricing
- Reviews and reputation
- Website quality
- Sales process
- Response time
- Service area
- Platform algorithm changes
- Third-party policy changes
- Client follow-up and fulfillment
We do not guarantee specific rankings, ad placements, lead volume, cost per lead, booked jobs, revenue, or return on investment.
11. Website, Landing Page, and SEO Services
If website, landing page, or SEO services are provided, you are responsible for reviewing all content, claims, offers, pricing, service descriptions, warranties, guarantees, and compliance-related statements before publication.
SEO work does not guarantee specific rankings, traffic levels, leads, or search engine placement.
Website and landing page work may rely on third-party platforms, hosting systems, DNS providers, analytics tools, tracking scripts, forms, plugins, or CRM systems.
12. AI, Automation, and Messaging Compliance
Some services may use automated or AI-assisted communication, including but not limited to SMS, email, chat, phone, voicemail, review requests, internal notifications, and follow-up workflows.
You are responsible for complying with applicable laws and regulations, including but not limited to TCPA, CAN-SPAM, A2P 10DLC requirements, privacy laws, advertising rules, and platform policies.
Opt-out mechanisms, such as replying STOP to SMS messages, will be honored where supported.
You agree not to use our systems to send spam, misleading messages, unlawful communications, or messages to contacts without proper consent.
13. SMS Communications and Consent
By submitting your information and providing consent, you agree to receive communications related to your account, inquiry, services, appointments, subscriptions, or business relationship with Elevated Automation.
Message frequency may vary. Message and data rates may apply.
You may opt out of SMS communications at any time by replying STOP. You may request assistance by replying HELP or contacting us directly.
We do not sell, rent, or share your phone number or SMS consent information with third parties for their marketing purposes.
14. Third-Party Services
Our services may rely on third-party platforms, including but not limited to Google, Meta, GoHighLevel, CallRail, Stripe, email/SMS providers, domain registrars, hosting providers, analytics tools, AI platforms, CRM systems, and other software providers.
We are not responsible for outages, errors, limitations, delays, pricing changes, policy changes, account suspensions, data loss, or changes caused by third-party platforms.
15. Intellectual Property
Unless otherwise agreed in writing, Elevated Automation retains ownership of its internal systems, processes, strategies, templates, workflows, automation structures, prompts, campaign structures, reporting formats, creative concepts, and proprietary materials.
Client-owned content, logos, brand assets, photos, business information, and pre-existing materials remain the property of the Client.
Upon full payment, website pages, landing pages, ad copy, and other deliverables created specifically for the Client may be used by the Client for its business, subject to any third-party platform limitations and the terms of the applicable agreement.
16. Access, Accounts, and Ownership
Clients are responsible for maintaining access to their own business accounts, including domains, ad accounts, Google Business Profiles, CRMs, tracking tools, websites, and billing accounts.
Where possible, ad spend and third-party platform costs should be paid directly by the Client to the platform.
Elevated Automation may request admin, manager, or collaborator access to perform services. Revoking required access may limit or stop our ability to provide services.
17. Disclaimer of Warranties
Services are provided "as is" and "as available" without warranties of any kind, whether express or implied.
We do not warrant that services will be uninterrupted, error-free, profitable, or suitable for every business.
18. Limitation of Liability
To the maximum extent permitted by law, Elevated Automation’s liability is limited to the amount paid by the Client for one month of services.
We are not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages, including but not limited to lost revenue, lost leads, lost rankings, ad account issues, platform suspensions, missed calls, missed messages, or third-party failures.
19. Suspension and Termination
Elevated Automation may suspend or terminate services immediately if:
- Payment is delinquent or fails.
- These Terms or a signed agreement are violated.
- Required access is removed or unavailable.
- System usage creates risk to operations, compliance, deliverability, or platform accounts.
- The Client engages in abusive, unethical, misleading, unlawful, or high-risk conduct.
- Third-party platform issues prevent service delivery.
Elevated Automation may also terminate services for any reason with reasonable notice.
20. Changes to Terms
We may update these Terms at any time. Updated Terms will be posted on our website with a revised effective date.
Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
21. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the State of Arizona, without regard to conflict of law principles.
